Priority Trademark Processing: Strategic Agility in Registration with the INPI

In a competitive environment where time is a differentiating factor, the ability to speed up a trademark registration can represent a crucial advantage. The Brazilian National Institute of Industrial Property (INPI) offers priority processing as a strategic solution for businesses that require faster recognition of their assets.
Priority processing is a procedure that allows a trademark application to be examined more quickly by the INPI. Instead of waiting for the standard timeframes — which can extend for years — the applicant can obtain a decision within months.
Those eligible to request priority processing include:
-
Companies participating in acceleration or incubation programs
-
Scientific, technological, and innovation institutions (ICTs)
-
Products or services related to public health
-
Trademarks associated with anti-piracy efforts
-
Applications linked to judicial proceedings
To do so, the applicant must provide supporting documentation and justify the request, always in compliance with the requirements of INPI Resolution No. 239/2019. After review, the INPI may grant priority status, expediting the steps until the final decision.
This new procedure offers greater agility and legal certainty to qualifying applicants.
Priority processing is an example of how intellectual property can be used strategically. Instead of waiting passively, companies and institutions can act intelligently to ensure the protection of their assets with greater speed.
